Welcome to Nextgun.ch. By accessing and using our platform, you agree to these General Terms and Conditions (GTC). Please read them carefully, as they define the rules and responsibilities of users of our marketplace. <\/p>\n

1. Introducing Nextgun<\/b><\/p>\n

Nextgun is an online platform for private individuals to buy and sell used firearms in Switzerland. Nextgun is not a gun seller<\/b> and does not participate in any transaction as a buyer or seller of firearms. We only facilitate contact between sellers and potential buyers. <\/p>\n

2. Using the Platform<\/b><\/p>\n

Nextgun provides a digital space to publish advertisements for the sale of used firearms between private individuals. By using our platform, users (buyers and sellers) agree to comply with all applicable laws and regulations, in particular those governing the sale, purchase and transfer of firearms in Switzerland. <\/p>\n

3. Seller’s liability<\/b><\/p>\n

It is the sole responsibility of the seller<\/b> to ensure that the transaction complies with applicable Swiss law, in particular the rules relating to :<\/p>\n

-Verification of the buyer’s identity.<\/p>\n

-Compliance with the criteria for legal possession of a firearm by the buyer.<\/p>\n

-Obtaining all necessary authorizations from the relevant authorities, including, where applicable, the application for an arms sales permit.<\/p>\n

Nextgun declines all responsibility<\/b> in the event of non-compliance with legal obligations by the seller.<\/p>\n

4. Buyer’s liability<\/b><\/p>\n

It is also the buyer’s responsibility to check that he meets the legal requirements for the acquisition of the weapon he wishes to purchase. Before finalizing the purchase, the buyer must ensure : <\/p>\n

-That he is in possession of the necessary permits for the purchase and possession of a firearm.<\/p>\n

-That he is eligible, under Swiss law, to own the weapon in question.<\/p>\n

-Comply with all identity verification and legal compliance procedures required by the authorities.<\/p>\n

Nextgun recommends the buyer to find out about applicable legal requirements before any transaction.<\/p>\n

5. Limitation of liability<\/b><\/p>\n

As a matchmaking platform, Nextgun accepts no liability for any dispute, damage or violation of the law<\/b> arising from a transaction carried out via our site. We do not intervene in transactions and assume no responsibility for : <\/p>\n

-Verification of the information provided by the seller.<\/p>\n

-The legality or conformity of the weapon offered for sale.<\/p>\n

-Users’ compliance with legal obligations.<\/p>\n

In the event of non-compliance with Swiss law or of a dispute between buyer and seller, Nextgun cannot be held liable<\/b> and does not provide any legal support.<\/p>\n

6. Compliance with laws and regulations<\/b><\/p>\n

By using our platform, users agree to comply with all applicable laws, regulations and local guidelines concerning firearms in Switzerland. Nextgun encourages its users to consult official resources and, if necessary, seek legal advice before proceeding with a transaction. <\/p>\n

7. Rules for publishing advertisements<\/b><\/p>\n

Nextgun users must comply with the following rules when publishing ads:<\/p>\n

-Gun descriptions must be accurate and not mislead buyers.<\/p>\n

-Photos must accurately represent the weapon for sale.<\/p>\n

-No advertisement may promote illegal weapons or weapons that do not comply with Swiss regulations.<\/p>\n

-Sales information must include all relevant details to ensure a compliant and transparent transaction.<\/p>\n

Nextgun reserves the right to remove any ad that does not comply with these rules without prior notice.<\/p>\n

8. Commitment of Users<\/b><\/p>\n

By creating an account on Nextgun and using our marketplace, users acknowledge that they are acting under their own responsibility and agree to abide by these TOU and all applicable laws. In case of violation of the platform rules or applicable laws, Nextgun reserves the right to suspend or delete the user’s account without prior notice. <\/p>\n
